We respect your data!

The trust of all visitors and customers, the security of your data and the protection of your privacy are of central importance. Your personal data will therefore be treated in accordance with the applicable legal data protection regulations and this privacy policy. Personal data is information that can be used to find out your identity, such as your real name, your address or your telephone number.
In principle, you can visit this website without providing any personal information. If personal data is collected, this is only done for the purpose of the enquiry or the respective order. Data will only be forwarded to third parties with your express consent. We would like to point out that data transmission on the Internet cannot be completely protected against access by third parties.
The following explains in more detail which data is collected, processed and used when and for what purpose. It will be explained how the services offered work and how the protection of your personal data is guaranteed.

Data collection on our website

Who is responsible for data collection on this website?
Data processing on this website is carried out by the website operator. You can find his contact details in the imprint of this website.

On the one hand, your data is collected when you provide it. This may, for example, be data that you enter in a contact form.
Other data is collected automatically by our IT systems when you visit the website. This is mainly technical data (e.g. internet browser, operating system or time of page access). This data is collected automatically as soon as you enter the website.

Some of the data is collected to ensure error-free provision of the website. Other data may be used to analyse your user behaviour.

What rights do you have regarding your data?

You have the right to receive information free of charge at any time about the origin, recipient and purpose of your stored personal data. You also have the right to demand the correction, blocking or deletion of this data. You can contact me at any time at the address given in the imprint with regard to this and other questions on the subject of data protection. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

GENERAL NOTES AND OBLIGATORY INFORMATION

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this data protection declaration.
When you use this website, various personal data are collected. Personal data is data by which you can be personally identified. This Privacy Policy explains what information we collect and how we use it. It also explains how and for what purpose this is done.
We would like to point out that data transmission on the Internet (e.g. when communicating by e-mail) can have security gaps. Complete protection of data against access by third parties is not possible.

Note on the responsible office

The responsible party for data processing on this website is:

Detlef Moews
Johanneswerkstr. 104
33613 Bielefeld
Telephone: 0521 – 42849506
info@moewsguitars.com

The data controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses, etc.).

Withdrawal of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. For this purpose, an informal communication by e-mail to us is sufficient. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from „http://“ to „https://“ and by the lock symbol in your browser line.
If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Information, blocking, deletion

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient and the purpose of the data processing and, if applicable, a right to correction, blocking or deletion of this data. You can contact us at any time at the address given in the imprint for this purpose and for further questions on the subject of personal data.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another responsible party, this will only be done insofar as it is technically feasible.

Objection to advertising e-mails

We hereby object to the use of contact data published within the scope of the imprint obligation for the purpose of sending advertising and information material that has not been expressly requested. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, for example by spam e-mails.

Data transfer

Personal data will only be transmitted to third parties if it is indispensable for the execution of the contract. This is the case, for example, with financial institutions that process the payment.
No other data will be transmitted unless you have expressly consented to this. An exception to this is the transfer of data if a legal or judicial authorisation exists or if we involve third parties who are bound to professional secrecy in order to enforce our rights.

System and information security

We secure our website and other systems by technical and organisational measures against loss, destruction, access, modification or distribution of stored data by unauthorised persons. Despite controls, however, complete protection against all dangers is not possible. Due to the connection to the Internet alone and the resulting technical possibilities, no guarantee can be given that content and the flow of information will not be viewed and recorded by third parties.

Transfer of your data to third countries

If we process personal data in a third country (i.e. a country outside the European Union or the European Economic Area) or have it processed by third parties, e.g. in the context of using a service, this is done solely for the purpose of fulfilling our contractual obligations, with your consent or on the basis of a corresponding legal obligation. The transfer or processing of your data to third countries will only take place in the event of the legal and/or contractual lawfulness of such transfer or processing and if the special conditions from Art. 44 ff DSGVO are met. Special conditions exist, for example, if the third country is officially recognised as having a level of data protection equivalent to that of the EU. Relevant guarantees or the agreement of officially recognised contractual obligations (so-called standard contractual clauses) also constitute special prerequisites for the transfer of data to third countries.

CONTACT REQUESTS / CONTACT OPTIONS

If you contact us via the contact form or e-mail, the data you provide will be used to process your enquiry. The provision of the data is necessary for the processing and answering of your enquiry – without their provision we cannot answer your enquiry or at best only to a limited extent.

The legal basis for this processing is Art. 6 para. 1 lit. b) DSGVO.

Your data will be deleted as soon as your enquiry has been finally answered and there are no legal obligations to retain data, e.g. in the case of subsequent contract processing.

Changes to our data protection regulations

We reserve the right to adapt this data protection declaration so that it always complies with the current legal requirements or in order to implement changes to our services in the data protection declaration, e.g. when introducing new services. The new privacy policy will then apply to your next visit.

Most of the cookies we use are so-called „session cookies“. They are automatically deleted at the end of your visit. Other cookies remain stored on your terminal device until you delete them. These cookies enable us to recognise your browser on your next visit.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. If you deactivate cookies, the functionality of this website may be limited.
Cookies that are required to carry out the electronic communication process or to provide certain functions that you have requested (e.g. shopping cart function) are stored on the basis of Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in storing cookies for the technically error-free and optimised provision of its services. Insofar as other cookies (e.g. cookies to analyse your surfing behaviour) are stored, these are dealt with separately in this data protection declaration.

CONFIGURATION OF COOKIE SETTINGS IN THE BROWSER

You have the option of preventing cookies from being stored on your computer by configuring your browser settings accordingly. Each browser differs in the way it manages cookie settings. The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • browser type and browser version
  • Operating system used
  • referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.
The basis for data processing is Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfilment of a contract or pre-contractual measures.

E-mail newsletter

If you use the option on our website to sign up or register for a newsletter, you agree to receive the newsletter and to the processing of your relevant personal data. As a matter of principle, we only send newsletters, e-mails or other electronic information with your prior consent and/or within the scope of legal regulations.

Our newsletters exclusively contain information and articles on current topics relating to the focus of this website, our services, relevant offers from third-party providers and ourselves. The dispatch of our newsletters and, if applicable, the measurement of success carried out after the newsletter has been sent is based on your consent in accordance with Art. 6 Para. 1 lit. a, Art. 7 DSGVO in conjunction with § 7 Para. 2 No. 3 UWG and/or on the basis of legal permission in accordance with § 7 Para. 3 UWG.

Registration for our newsletter takes place in the so-called double opt-in procedure. This means that you first enter your email address to register for the newsletter. If applicable, you will optionally be asked to enter your first and last name so that we can address you personally. In a second step, you will receive an e-mail at the address you have given, in which there is a link to confirm your registration. Only after your registration has been activated have you successfully registered for my newsletter. The registrations for the newsletter are logged in the interest of legal bindingness.

Our newsletter is sent using the MailChimp (http://www.mailchimp.com) mailing service provider of the US company Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. MailChimp uses its own privacy policy for handling personal data, which you can view at the address https://mailchimp.com/legal/privacy/. MailChimp is certified under the Privacy Shield agreement and guarantees to comply with the European level of data protection. We use MailChimp on the basis of our legitimate interest as well as a contract processing agreement pursuant to Art. 28 (3) p. 1 DSGVO. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with its data protection provisions and, in particular, not to pass it on to third parties. Please note that MailChimp may use your data in anonymised form (i.e. without assigning it to a specific user) to optimise its own services, to ensure the correct display of the newsletter or to collect statistical analyses. MailChimp will not use your personal data to contact you independently for its own purposes or to pass it on to third parties.

Cancellation/revocation

You can cancel the receipt of our newsletter at any time, i.e. revoke your consent.
You will find a link to cancel the newsletter at the end of each newsletter.
You have the option of unsubscribing or cancelling the receipt of my newsletter at any time.
For this purpose, each newsletter contains a link at the end of the content. You also have the option of unsubscribing from our newsletter by e-mail, telex or telephone. This will also terminate your consent to the sending of the newsletter via MailChimp and the statistical analyses. Unfortunately, it is not possible to separately revoke the sending via MailChimp or the statistical analysis.
Please note that we are legally entitled to retain the email address you provided when registering for our newsletter for up to 3 years after cancelling the newsletter – for example, in order to be able to legally prove consent previously given. However, the correspondingly stored data is kept exclusively for the purpose of maintaining legal security.

Online call and data management

There are cases where we direct newsletter recipients to MailChimp’s websites. E.g. our newsletters contain a link with which newsletter recipients can call up the newsletters online (e.g. in the event of display problems in the email programme). Furthermore, newsletter recipients can subsequently correct their data, such as the email address. Likewise, MailChimp’s privacy policy can only be accessed on their site.

In this context, we pointed out that cookies are used on MailChimp’s websites and that personal data is thus processed by MailChimp, its partners and service providers used (e.g. Google Analytics). We have no influence on this data collection. For further information, please refer to MailChimp’s privacy policy. We would also like to draw your attention to the possibility of objecting to the collection of data for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/v (for the European area).

Provision of chargeable services

For the provision of chargeable services, we request additional data, such as payment details, in order to be able to execute your order. We store this data in our systems until the statutory retention periods have expired.

SOCIAL MEDIA

Sharing content via plugins (Facebook, Google+1, Twitter & Co.)

Our users can share the content of this site on social networks in a data protection-compliant manner without complete surfing profiles being created by the operators of the networks.

PLUGINS AND TOOLS

Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses so-called „cookies“. These are text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

Google Analytics cookies are stored on the basis of Art. 6 (1) lit. f DSGVO. The website operator has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising.

IP anonymisation

We have activated the IP anonymisation function on this website. This means that your IP address is shortened by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

Browser plugin

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. In addition, you can prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plugin available at the following link:https://tools.google.com/dlpage/gaoptout?hl=de.

Objection to data collection

You can prevent the collection of your data by Google Analytics by clicking on the following link. An opt-out cookie will be set which will prevent the collection of your data on future visits to this website: [ga-optout text=“Disable Google Analytics“].

More information on how Google Analytics handles user data can be found in Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.

Order data processing

We have concluded an order data processing contract with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Demographic characteristics with Google Analytics

This website uses the „demographic characteristics“ function of Google Analytics. This allows reports to be generated that contain statements about the age, gender and interests of site visitors. This data comes from interest-based advertising from Google as well as visitor data from third-party providers. This data cannot be assigned to a specific person. You can deactivate this function at any time via the ad settings in your Google account or generally prohibit the collection of your data by Google Analytics as shown in the item „Objection to data collection“.

Use of script libraries (Google Webfonts)

In order to display our content correctly and in a graphically appealing manner across browsers, we use script libraries and font libraries such as Google Webfonts (https://www.google.com/webfonts/) on this website. Google Web Fonts are transferred to your browser’s cache to avoid multiple loading. If the browser does not support Google Web Fonts or prevents access, content is displayed in a standard font.

For this purpose, the browser you are using must connect to Google’s servers. This enables Google to know that our website has been accessed via your IP address. It is theoretically possible – although it is currently unclear whether and, if so, for what purposes – that the operators of such libraries collect data.

Google Web Fonts are used in the interest of a uniform and appealing presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO.

Further information on Google Web Fonts can be found at https://developers.google.com/fonts/faq and in Google’s privacy policy: https://www.google.com/policies/privacy/.

„Share“ function for social networks

We offer you the option of using so-called „social media buttons“ on our website. By clicking on the graphic, you are thus forwarded to the services of the respective providers. Only then will your data be sent to the respective providers. If you do not click on the graphic, there is no exchange between you and the providers of the social media buttons. Information on the collection and use of your data in the social networks can be found in the respective terms of use of the corresponding providers.

YouTube

Our website uses plugins from the YouTube site operated by Google. The operator of the pages is YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA.
When you visit one of our pages equipped with a YouTube plugin, a connection to the YouTube servers is established. This tells the YouTube server which of our pages you have visited.
If you are logged into your YouTube account, you enable YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.
YouTube is used in the interest of an appealing presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 Para. 1 lit. f DSGVO.
Further information on the handling of user data can be found in YouTube’s privacy policy at: https://policies.google.com/privacy?hl=de&gl=de.

Facebook Pixel

Our website uses the visitor action pixel from Facebook, Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA („Facebook“) for conversion measurement.

This makes it possible to track the behaviour of page visitors after they have been redirected to the provider’s website by clicking on a Facebook ad. This allows the effectiveness of the Facebook ads to be evaluated for statistical and market research purposes and future advertising measures to be optimised.

The data collected is anonymous for us as the operator of this website, we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook data usage policy. This enables Facebook to serve advertisements on Facebook pages as well as outside of Facebook. This use of the data cannot be influenced by us as the site operator.

You can find further information on protecting your privacy in Facebook’s privacy policy: https://www.facebook.com/about/privacy/.

You can also deactivate the „Custom Audiences“ remarketing function in the settings section for advertisements at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. To do this, you must be logged in to Facebook.

If you do not have a Facebook account, you can disable usage-based advertising from Facebook on the European Interactive Digital Advertising Alliance website: http://www.youronlinechoices.com/de/praferenzmanagement/.

YouTubeVIMEO

We use the provider Vimeo, among others, for the integration of videos. Vimeo is operated by Vimeo, LLC with headquarters at 555 West 18th Street, New York, New York 10011.

We use plugins from the provider Vimeo on some of our Internet pages. When you call up the Internet pages of our website that are provided with such a plugin, a connection is established to the Vimeo servers and the plugin is displayed. This transmits to the Vimeo server which of our Internet pages you have visited. If you are logged in as a Vimeo member, Vimeo assigns this information to your personal user account. When using the plugin, such as clicking on the start button of a video, this information is also assigned to your user account. You can prevent this assignment by logging out of your Vimeo user account before using our website and deleting the corresponding cookies from Vimeo.

Further information on data processing and notes on data protection by Vimeo can be found at https://vimeo.com/privacy.
